The British pride themselves on being less litigiously minded than Americans when it comes to medicine. Watching some of the debate over the Medical Innovation Bill, or ‘Saatchi’s Bill’, leads me to doubt this. Both sides of the debate have made the preservation of the existing law essential to their case, without realising its deeper flaws. We should have more ambition, and consider radically different systems to compensate for negligence.
